This workshop, appropriate for all levels, will review the requirements of non-LPR Cancellation of Removal, an important form of defensive relief for clients in removal proceedings, and discuss the common obstacles to proving eligibility. We will discuss the heightened hardship standard for this form of relief, how a criminal conviction can bar your client from non-LPR cancellation, and recent updates in the “stop-time rule.” We will also discuss some procedural challenges with non-LPR cancellation, including the statutory cap on grants that can be issued each year.
