USCIS May Soon Publish Final Rule Increasing Filing Fees

On Jan. 4, 2023, USCIS published a Notice of Proposed Rulemaking that put forward significant increases to fees for applying for many immigration benefits. On Mar. 10, 2023, CLINIC submitted a Public Comment, expressing opposition to USCIS’s proposed filing fee increases and changes to certain other immigration benefit request requirements. CLINIC asserted that these changes would deeply impact the communities we and our affiliates serve. The White House’s Office of Information and Regulatory Affairs is reviewing the final rule, and the rule could be published in the Federal Register any day. The text of the final fee rule, including filing fee increases, will not become available until the rule is published. Once published, the final fee rule may take effect 60 days later.
We urge affiliates to review the proposed changes in filing fees to identify whether you have clients that may need petitions or applications filed before any significant filing fee increase takes effect.
