Waivers of the grounds of inadmissibility are an essential part of immigration practice. This four-part webinar series will present information on both the theory and practice of developing successful waiver applications. Participants will learn the legal standards of extreme hardship, how to create a theory of the case, how to marshal the facts and what kinds of supporting documentation to submit. The presenters will include detailed information on the provisional waiver program and agency guidance on extreme hardship. By the end of the series, participants will be better able to analyze the strengths and weaknesses of specific cases and advise clients on their chances for success.

Webinar 1: Overview of the Grounds of Inadmissibility

Oct. 7 | 2-3:30 p.m. ET | CA MCLE 1.5

In this first webinar, the presenters will review the most common grounds of inadmissibility and the waivers available. Presenters will go into some depth on both the eligibility requirements for all possible waivers and some of the subtleties practitioners can encounter. This webinar will prepare practitioners to counsel clients on their various options and the best course of action. 

 


Webinar 2: Extreme Hardship and Discretion

Oct. 14 | 2-3:30 p.m. ET | CA MCLE 1.5

This webinar will explore the legal standard of "extreme hardship," whose meaning derives from case law and is central to many of the inadmissibility waivers. Presenters will discuss the current U.S. Citizenship and Immigration Services guidance on extreme hardship and how that is applied to waiver adjudication. The presenters will also discuss the role that discretion plays. 

 


Webinar 3: Working with Clients to Build Strong Cases

Oct. 21 | 2-3:30 p.m. ET | CA MCLE 1.5

This webinar will focus on preparing the declarations of the qualifying relative and the waiver applicant and obtaining the documents that support each hardship claim. The presenters will provide practical advice on how to identify other potential supporting documents; locate and use experts; and obtain reports, articles or other evidence. 

 


Webinar 4: Putting the Case Together

Oct. 28 | 2-3:30 p.m. ET | CA MCLE 1.5

This webinar will cover the I-601A provisional waiver program. The presenters will also cover how to present your client's waiver application to USCIS in a persuasive and organized manner. They will discuss how to prepare an effective cover letter, identify the documentation in an index of exhibits and organize all the documents.
