Employment-Based Fourth Category (EB4) “Special Immigrant Religious Workers” Facing Priority Date Limits in December 2022 Visa Bulletin

The December 2022 Visa Bulletin issued by the Department of State announced a high demand for immigrant (permanent residence) visas and requiring limits for all countries under the category. In turn, U.S. Citizenship and Immigration Services, or USCIS, has announced that all countries except El Salvador, Guatemala, Honduras, and Mexico are now subject to a priority date limit of July 22, 2022 (22JUL22).

Please be advised that if you are submitting an I-485 Adjustment of Status Application in December 2022 for a religious worker based on an approved I-360 Special Immigrant Petition you must check the priority date (the date the I-360 was filed with USCIS) of the I-360 to ensure the religious worker is eligible to submit his or her I-485 this month. If the priority date is not current or is a date after the dates listed above, the religious worker is not yet eligible to adjust status. For more information, please contact your RIS Attorney.
