New R&A Forms to be Mandatory

The Executive Office for Immigration Review, or EOIR, has updated the webpage for the Recognition and Accreditation program to indicate that as of Dec. 14, 2020, EOIR will no longer accept previous versions of Forms EOIR-31 and EOIR-31A. The versions dated February 2020 will be required after that date.
The February 2020 versions of the forms were published on EOIR’s website in May 2020, but EOIR informed CLINIC that the previous version of the form could continue to be used for the time being. CLINIC advised its network to continue to use the previous version of the form, as we had concerns about the procedure and some questions on the February 2020 version of the forms, and asked EOIR to rescind them. CLINIC’s concerns about the February 2020 forms have not been alleviated. CLINIC affiliates planning to file applications for R&A are encouraged to reach out to their Field Support Coordinator if the questions in the new forms will negatively impact their organization, employees or volunteers.
