The Child Status Protection Act applies to the derivative children of Afghans who qualify for permanent residency under the Special Immigrant Via program. Practitioners should be aware of the applicability of the CSPA to the SIV program and understand what steps they need to take in order to preserve CSPA eligibility for their clients. This article summarizes the CSPA, how it applies to Afghan SIV applicants, and the recent changes in the SIV petition process.
