Afghans arriving along the U.S.-Mexico border may be paroled into the United States pursuant to section 212(d)(5) of the Immigration and Nationality Act (INA). This commonly occurs for those who present at a port of entry and are designated as “arriving aliens.” However, the Department of Homeland Security (DHS) typically does not consider those who enter or attempt to enter the U.S. without inspection to have been paroled into the United States, even if they are subsequently released into the United States. This stance has implications for both benefits access and employment authorization.
