State and Local Immigration Project Answers Pope Francis’s Call

As many state legislatures gather this spring, CLINIC’s State and Local Immigration Project is out in full force engaging with our network to build stronger, safer communities for us all through pro‐immigrant legislation and advocacy. Pope Francis’s Lenten Message reminds us that love, justice and solidarity are not achieved only once but must be realized each day. Similarly, state and local advocacy is not bound only by legislative sessions; it requires year‐round work to uplift immigrants’ stories and prepare the network to advocate in their communities.

Here are a few of our recent highlights:

  • Provided crucial written and oral testimony in front of the Maryland state legislature in support of a bill that would guarantee access to counsel for immigrants at risk of deportation. In line with Catholic social teaching, CLINIC’s statement urged lawmakers to “view migration not as a divisive phenomenon, but as an occasion to build the human family” and made clear that “service to newcomers constitutes an obligation to persons of faith, not an option.”
  • Conducted outreach and education to communities on the Department of Homeland Security’s new policy on Protected Areas, first announced in October 2021. The policy expanded locations safeguarded from immigration enforcement to areas survivors of domestic violence access, facilities serving disabled persons, and many others. In February, CLINIC’s state and local attorney was a featured speaker on a major training on the topic, attended by nearly 200 immigration advocates.
  • Supported the Catholic Conference in Florida, as the state legislature moved a bill (SB 1808/HB 1355) that would harm unaccompanied children and family reunification by impacting common carriers that transport undocumented immigrants into the state of Florida. It will also force each law enforcement agency operating a county detention facility to enter into a 287(g) agreement by Jan. 1, 2023. This undoubtedly will increase racial profiling in the state and will decrease immigrant trust in law enforcement, which puts allpublic safety at risk. Introducing RIS Attorney: Nicholas Frank

What type of work do you do at CLINIC?

I work as a staff attorney in the Religious Immigration Services section where I aid religious organizations and their members with their immigration-based legal needs.

Where did you work/what were you doing before joining CLINIC?

Before joining CLINIC, I was helping the Executive Office of Immigration Review’s Office of General Counsel handle immigration-based Freedom of Information Act, or FOIA, requests.

How did you become interested in immigration?

I became interested in immigration during law school. I was doing the international concentration, which included studying immigration. After studying, I decided I wanted to try practicing immigration hands-on, so I did an internship here at CLINIC, which cemented my interest in the field.

What do you like most about working in religious immigration law?

What I enjoy most about religious immigration law is the chance to practice in a complex field I enjoy while helping members of the Church with their needs.

What do you wish other people had told you before you took the role?

Thankfully, having interned at CLINIC in the past, I had a fairly good idea of what I was stepping into.

If you could give one piece of advice to an aspiring law clerk working in the immigration field, what would it be?

In this field you will constantly have a lot of different work for clients with various competing deadlines, so make things easier on yourself by getting and staying organized.

What is the most fulfilling part of your job?

This largely goes back to what I enjoy about religious immigration law. I truly find fulfillment in being able to help all these religious organizations and their members navigate the complex, ever shifting and always crucial field of immigration.

Social Worker - SOAR

Summary:

To assist with developing an interdisciplinary approach that would integrate social work into the legal services provided to SOAR Legal’s clients and implement best practices to support meaningful access to justice. The mission and goals of Ecumenical Ministries of Oregon (EMO) as determined by the Board of Directors, and as administered by the President and his/her delegates.

Responsibilities:

  • Develop and manage SOAR Legal’s pro bono mental health network, in coordination with the Director. Recruit psychiatrists, psychologists and LCSWs to provide free psychiatric evaluations to SOAR Legal’s clients, to support asylum applications and extreme hardship determinations.
  • Set regular meetings, provide and coordinate training, and other duties associated with this work.
  • Provide and develop training for SOAR Legal staff in the areas of trauma informed care, self care, secondary trauma and other relevant topics.
  • Provide support to SOAR Legal staff on matters related to social work approaches and interventions, including trauma informed care.
  • Maintain case files and database to ensure confidentiality and compliance with monitoring and documentation standards. Assist attorneys and staff members to identify clients in need of specialized case management.
  • Conduct culturally competent assessments to inform service planning, referrals and advocacy.
  • Develop individual service plans with attention to culture, language and special circumstances. Assist clients with resource navigation.
  • Provide interpretation and translation for SOAR Legal clients, as needed.
  • Put forth a courteous, friendly, helpful attitude with staff and clients;
  • Ability to be self-directed and work as a member of a team;
  • Maintain a high standard of professional communication when communicating with clients and external partner
  • Other duties as assigned.

Qualifications:

  • Ability to work within the mission, vision and ethics of EMO, and maintain an understanding of the services provided by the programs and projects of EMO.
  • EMO requires all staff in this position to be vaccinated for the safety of our clients.
  • Able to communicate fluently in English and either Dari, Pashto, Spanish, Somali, Arabic, Burmese or Ukrainian.

Legal Assistant - SOAR

Summary:

This position provide administrative support for attorneys and BIA accredited representatives. The mission and goals of Ecumenical Ministries of Oregon (EMO) as determined by the Board of Directors, and as administered by the President and his/her delegates.

Responsibilities:

  • Provide administrative support to SOAR attorneys and BIA accredited representatives.
  • Conduct potential client intakes, and provide referral and information assistance to community members.
  • Schedule client appointments and send appointment reminders.
  • Follow procedures consistent with case management guidelines, including creating physical and electronic case files, maintaining files, closing files, etc.
  • Receive and record client mail, file mail and contact all clients regarding the mail.
  • Contact clients to remind them of appointments or classes.
  • Serve as a back up for the front desk Legal Assistant, which would involve providing reception for the SOAR Immigration Legal Services Portland office, including answering the phone, directing phone calls, greeting clients, and acting as a liaison between clients and other legal staff.

Staff Attorney - SOAR

Summary:

This position provides direct legal services to low income and culturally diverse immigrants. The mission and goals of Ecumenical Ministries of Oregon (EMO) as determined by the Board of Directors, and as administered by the President and his/her delegates.

Responsibilities:

  • Provide direct legal representation to low income clients with USCIS administrative applications and selected cases in immigration court on a broad range of immigration cases, including: family based petitions, asylum, adjustment of status, naturalization, consular processing, Deferred Action for Childhood Arrivals, U visas, and other immigration remedies.
  • Manage caseload of Afghan parolee cases and keep up to date on changes in immigration law and policy for Afghan arrivals.
  • Collaborate with Legal Afghan team and SOAR Refugee Resettlement Afghan team.
  • Plan and coordinate SOAR virtual and in-person Citizenship Day and Afghan Humanitarian Parole Clinics.
  • Hold community presentations on immigration topics.
  • Recruit, coordinate training, and provide support for volunteer attorneys, law students, and legal assistants.
  • Submit monthly reports on services rendered.
  • Other duties as assigned.

Qualifications:

Knowledge:

  • Must be a lawyer in good standing with the Bar of any state, and meet the requirements of ORS 9.280 and the Oregon Rules of Professional Conduct;
  • Prefer attorney with at least two years of experience in immigration law;
  • Ability to communicate in Spanish and English, or another second language commonly used with our clients;
  • Proven proficiency using software programs for data and word processing;
  • Must possess valid driver’s license and evidence of insurability.
