Understanding Motions to Rescind and Reopen In Absentia Orders of Removal

Where a noncitizen has been ordered removed because they did not attend their immigration court hearing, a motion to rescind and reopen may be an important tool for helping the noncitizen remain in or return to the United States. Yet drafting an effective motion to rescind and reopen requires an in-depth understanding of the procedural rules governing motions to rescind and reopen. This panel will provide an overview of the procedures for filing these motions before the immigration courts, with a special focus on recent changes to motions practice.
