Understanding Motions to Reopen

Where a noncitizen already has a final order of removal, a motion to reopen may be an important tool for helping the noncitizen remain in or return to the United States. Yet drafting an effective motion to reopen requires an in-depth understanding of the procedural rules governing motions to reopen. This panel will provide an overview of the procedures for filing motions to reopen before the BIA and the immigration courts, with a special focus on recent changes to motions practice.
