In the almost 15 years since the Child Status Protection Act was implemented, most practitioners probably have a basic grasp of the fundamental principles. But it has subtleties and more areas of complexity. Let’s do a quick review.

Question

Mariela is an approved Violence Against Women Act, or VAWA, self-petitioner who would like to apply for adjustment of status. When I received Mariela’s records through the Freedom of Information Act, I discovered that she had been granted voluntary departure by an immigration judge in 1995. She never left the United States because of her abusive husband. Is Mariela eligible for adjustment of status? If so, can she file with USCIS?
