Family-sponsored adjustment applicants use Dates for Filing chart in October

U.S. Citizenship and Immigration Services has determined that adjustment of status applicants in the family preference categories may use Chart B, Dates for Filing Family-Sponsored Visa Applications, of the Visa Bulletin for the month of October. Starting Oct. 1, applicants with priority dates earlier than the dates listed on Chart B may file their I-485 applications with USCIS.

Each month, USICS indicates whether Chart B may be used. It is advantageous to file under Chart B since applicants are eligible for employment authorization and permission to travel with advance parole during the pendency of the adjustment application. The adjustment application will remain pending until the priority date is current, based on Chart A, Final Action Dates for Family-Sponsored Preference Cases.   

Applicants in the employment preference categories must still use Chart A, Final Action Dates for October.

Practitioners should check the USCIS website www.uscis.gov/visabulletininfo monthly to determine which visa bulletin chart to use.
